Federal High Court terminates eight-count charge filed by police after AGF review reveals jurisdictional gaps, clearing way for immediate prosecution at FCT High Court.
ABUJA, Nigeria — The Federal High Court in Abuja has struck out the eight-count criminal charge brought against Prince Adeniyi Adeyemi, the self-styled Director-General of the alleged unapproved “Presidential Foreign Investment Promotion Council” (PFIPC).
Presiding Judge, Justice Mohammed Umar, terminated the proceedings on Monday, October 12, 2026, following a formal application by the Federal Government to withdraw the initial charge filed by the Inspector-General of Police (IGP).
Moving the application, the Director of Public Prosecutions of the Federation (DPPF), Rotimi Oyedepo, SAN, informed the court that the Attorney-General of the Federation and Minister of Justice (AGF) reviewed the case file and identified jurisdictional and procedural loopholes in the original police charge. Oyedepo explained that the specific offenses—which center on the alleged forgery of government documents and impersonation—fall under the judicial jurisdiction of the High Court of the Federal Capital Territory (FCT) rather than the Federal High Court.
The DPPF confirmed that a fresh charge has already been drafted and filed at the FCT High Court, where Adeyemi will be re-arraigned expeditiously. Defence counsel, Ibrahim Angulu, SAN, raised no objections to the application, prompting Justice Umar to formally strike out the charge.
The controversy around Adeyemi broke after federal authorities accused him of establishing a non-existent presidential agency, posing as its Director-General, and attempting to secure budgetary allocations under the guise of promoting foreign direct investment. The case has drawn widespread attention across institutional oversight bodies and economic analysts, who have called for tightened inter-agency auditing and strict verification of public entities seeking statutory budget inclusion.
Adeyemi is expected to be transferred to the FCT High Court for his fresh plea and trial proceedings.
